Berdo 2.0 Phase 3 Updates

On Wednesday, 08.16.2023, at the monthly Air Pollution Control Commission, updates to BERDO 2.0 Phase 3 regulations and policies that relate to Building Portfolios and Individual Compliance Schedules (ICS), were presented. These updates were based on stakeholder comments received. Draft straw proposals on Hardship Compliance Plans (HCP) and the Equitable Emissions Investment Fund (EEIF) were also presented.
The following are available for review:
- Updated draft BERDO 2.0 Phase 3 regulations for Building Portfolios and ICS based on stakeholder comments (attached)
- Updated draft BERDO 2.0 Phase 3 policies for Building Portfolios and ICS based on stakeholder comments (attached)
Comments on these updated Phase 3 regulations and policies are now due on Friday, September 15, 2023, at noon.
In addition, straw proposals were provided for:
- Hardship Compliance Plans (slides 35-52)
- A public technical working session focused on Hardship Compliance Plans will be held on Tuesday, August 22, 2023, from 1:00 to 2:30 pm ET on Zoom. Please register for the meeting here.
- Equitable Emissions Investment Fund (slides 53-60)
- A public working session focused on the Equitable Emissions Investment Fund will be on Wednesday, August 23, 2023, from 1:00 to 2:30 pm ET on Zoom. Please register for the meeting here.
Informal comments regarding the Hardship Compliance Plan and Equitable Emissions Investment Fund are also being accepted until Friday, September 15, 2023, at noon.
